1. About the Platform
1.1 Kolom Academy is an online learning marketplace. We host courses created both by us and by independent third-party instructors.
1.2 For courses published by third-party instructors, Kolom Academy acts as the hosting and payment platform, not as the author or provider of the course. The instructor is responsible for the accuracy, quality, and legality of their own content.
1.3 The Platform is available in English and Bangla. Where a translated version of these Terms differs from the English version, the English version prevails.
1.4 Courses are offered for educational purposes only. Nothing on the Platform constitutes professional, legal, medical, or financial advice.
2. Definitions
- "Student" — any user who enrols in or purchases a course.
- "Instructor" — any user approved to publish courses on the Platform.
- "Content" — videos, text, quizzes, assignments, downloadable files, and any other material made available on the Platform.
- "Account" — the personal user account created to access the Platform.
3. Eligibility and Accounts
3.1 You must be at least 18 years old to create an account and make a purchase. If you are under 18, you may use the Platform only with the involvement and consent of a parent or legal guardian, who accepts these Terms on your behalf.
3.2 You agree to provide accurate, current, and complete information when registering, and to keep it up to date.
3.3 Your account is personal to you. Your username and password may not be shared, sold, transferred, or lent to anyone else. Accounts found to be shared may be suspended or terminated without refund.

4.1 All prices are listed in Bangladeshi Taka (BDT) unless stated otherwise, and are inclusive of applicable taxes unless we state otherwise at checkout.
4.2 Payment must be completed in full before course access is granted. We accept payments through the methods shown at checkout, including mobile financial services and card payments processed by third-party payment gateways.
4.3 We do not store your full card or mobile wallet credentials. Payment processing is handled by our payment partners under their own terms and security standards.
4.4 Course prices, discounts, and promotional offers may change at any time. A price change will not affect a purchase you have already completed.
4.5 If a payment is declined, reversed, or charged back, we may suspend access to the affected course until the matter is resolved.
4.6 Coupons and promotional codes are subject to their stated conditions, cannot be exchanged for cash, and may be withdrawn at any time.
5. Course Access and Licence
5.1 On successful payment, you receive a limited, personal, non-exclusive, non-transferable licence to access and view the course content for your own learning.

5.3 You may not:
- download, record, screen-capture, or copy course content except where a download option is expressly provided;

5.4 We may update, revise, or discontinue a course at any time. Where a course is permanently removed, we will give reasonable notice to enrolled students and, where appropriate, provide continued access or an alternative.
5.5 Before purchasing, it is your responsibility to check that a course suits your needs. Course pages include a description, curriculum outline, and where available a preview video for this purpose.
6. Refunds
6.1 Our full refund terms are set out in our Refund Policy, which forms part of these Terms.
6.2 In summary: because courses are digital products delivered immediately, refunds are available only within [NUMBER] days of purchase and only where you have consumed less than [NUMBER]% of the course content.
6.3 Refunds are normally granted in cases of duplicate payment, failure of delivery, or a technical fault on our side that prevents access and cannot be resolved.
6.4 Refunds are not available where a course has been substantially completed, where a certificate has been issued, or where these Terms have been breached.
6.5 Courses cannot be exchanged for a different course after purchase unless we agree otherwise in writing.
7. Instructor Terms
This section applies if you publish courses on the Platform.
7.1 Approval. Instructor accounts are subject to review and approval. We may decline or revoke instructor status at our discretion.
7.2 Ownership. You retain ownership of the content you upload. You grant Kolom Academy a worldwide, non-exclusive, royalty-free licence to host, stream, reproduce, promote, and make your content available to students through the Platform for as long as your course is published, and for as long as enrolled students retain access rights.
7.3 Your warranties. You confirm that you own or have all necessary rights to the content you upload, that it does not infringe any copyright, trademark, or other right, and that it does not contain unlawful, misleading, or harmful material.
7.4 Quality standards. Courses must meet our published quality and content guidelines. We may request changes, unpublish a course, or remove it if it does not meet those standards or attracts sustained student complaints.
7.5 Revenue share and payouts. Instructors receive [NUMBER]% of net course revenue (the amount received after payment gateway fees, taxes, refunds, and any applicable discounts). Payouts are made [monthly / on request], subject to a minimum balance of [AMOUNT] BDT, and are released after the refund window for the relevant sales has closed.
7.6 Pricing. We may run platform-wide promotions and discounts. Instructor earnings are calculated on the actual amount received from the student.
7.7 Taxes. Instructors are responsible for declaring and paying their own income tax, VAT, and any other applicable taxes on their earnings. We may withhold amounts where required by Bangladeshi law.
7.8 Removal. If your content is removed for a breach of these Terms, we may withhold related earnings pending investigation.
8. Prohibited Conduct
You agree not to:
- share your account credentials or attempt to access another user's account;
- copy, pirate, or distribute course material;
- attempt to bypass payment, access restrictions, or digital rights protections;
- upload viruses, malicious code, or attempt to interfere with the operation or security of the Platform;
- scrape, crawl, or use automated tools to extract content;
- post abusive, threatening, defamatory, obscene, or discriminatory messages in comments, forums, Q&A sections, or community groups;
- impersonate another person or misrepresent your affiliation with any person or organisation;
- use the Platform for any unlawful purpose or in breach of Bangladeshi law.
Breach of this section may result in immediate suspension or permanent termination of your account without refund, and may be reported to the relevant authorities.
9. Intellectual Property
9.1 The Platform itself — including its design, layout, source code, logo, brand name, graphics, and all content created by Kolom Academy — is owned by or licensed to us and protected by copyright and other laws.
9.2 Trademarks appearing on the Platform that do not belong to us are acknowledged as the property of their respective owners.
9.3 Unauthorised reproduction or distribution of our content or an instructor's content is a violation of these Terms and may give rise to civil and criminal liability under the Copyright Act of Bangladesh and related legislation.
9.4 Copyright complaints. If you believe content on the Platform infringes your rights, email [SUPPORT EMAIL] with details of the work, the location of the infringing material, and confirmation that you are the rights holder or authorised to act on their behalf. We will investigate and remove infringing material where a complaint is substantiated.
10. Certificates

10.2 Certificates confirm that a course was completed on our Platform. They are not an academic, professional, or government-accredited qualification unless explicitly stated.
10.3 We may revoke a certificate obtained through fraud, account sharing, or breach of these Terms.
11. Third-Party Links and Services
11.1 The Platform may contain links to third-party websites, tools, or resources. These are provided for convenience only.
11.2 We do not control and are not responsible for the content, policies, or practices of third-party sites, and their inclusion does not imply endorsement.
11.3 Your use of any third-party service, including payment gateways and social login providers, is governed by that provider's own terms.
12. Disclaimers
12.1 The Platform and its content are provided "as is" and "as available". While we work to keep information accurate and current, we do not warrant that content is complete, error-free, or suitable for any particular purpose.
12.2 We do not guarantee uninterrupted or fault-free access. The Platform may be unavailable during maintenance or due to circumstances beyond our control.
12.3 No outcome guarantee. We do not promise any specific result from taking a course — including employment, freelance income, business growth, or exam success. Results depend on your own effort, skill, and circumstances.
12.4 Any earnings figures, testimonials, or success stories shown on the Platform reflect individual experiences and are not a guarantee of your results.
13. Limitation of Liability
13.1 To the maximum extent permitted by law, Kolom Academy, its owners, employees, and partners shall not be liable for any indirect, incidental, special, or consequential loss, including loss of profit, income, data, or opportunity, arising from your use of the Platform.
13.2 Where liability cannot be excluded, our total liability to you for any claim is limited to the amount you actually paid to us for the course giving rise to the claim in the twelve months preceding the claim.
13.3 As a merchant, we are not liable for failed transactions caused by insufficient funds, transaction limits set by your bank or wallet provider, or authorisation failures outside our control.
14. Indemnity
You agree to indemnify and hold Kolom Academy harmless against any claim, damage, loss, or expense (including reasonable legal fees) arising from your breach of these Terms, your misuse of the Platform, or — if you are an instructor — any claim relating to content you have uploaded.
15. Suspension and Termination
15.1 You may close your account at any time by contacting support. Closing your account does not automatically entitle you to a refund.
15.2 We may suspend or terminate your account, with or without notice, if you breach these Terms, if we are required to do so by law, or if we reasonably suspect fraudulent or abusive activity.
15.3 On termination, your licence to access course content ends immediately.
16. Changes to These Terms
16.1 We may update these Terms at any time. The revised version takes effect when posted on this page, with an updated "Last updated" date.
16.2 For material changes, we will make reasonable efforts to notify registered users by email or an on-site notice.
16.3 Continuing to use the Platform after changes are posted means you accept the revised Terms.
17. Governing Law and Disputes
